RENTAL AGREEMENT CONDITIONS:
A rental agreement will be signed by both parties and can be adapted per rental but these are the basic conditions:
1. Party Members
Maximum number of occupants – Six (6)
A list of names and ages will be required.
2. Rental Period
The period of rental will be noted from XXXXX – XXXXX. The property will be ready for occupancy from 4 pm on XXXXX and must be vacated by 11am on the XXXXXX (unless otherwise agreed with THE OWNER in writing).
3. Payment, Damage Deposit, and Damage Protection
Deposit on rental required upon booking to guarantee, usually about 20%.
Please send a cheque/check if possible. Statement of account will be sent to you.
Refundable Damage Deposit $250.00 (Separate cheque/check post-dated)
The Damage Deposit should be by separate cheque/check, which will not be cashed unless THE OWNER has a valid claim to make upon. If no claims are made then the damage deposit cheque/check will be voided and returned 4 weeks after THE RENTER's departure from the condo. Alternatively, the Refundable Damage Deposit can be made via Paypal, in which case the Deposit will also be refunded via Paypal.
Payment methods accepted are via Check/Cheque or Paypal.

Checks/Cheques are to be made payable to the owner, details will be supplied at time of booking.
All persons listed will be bound by the terms of the agreement.
4. Personal to The Renter
This Rental Contract is between the Owner and The Renter(s) and the members of the Renters party as identified. The Rental Contract cannot be sublet, assigned, or transferred under any circumstances.

5. Utilities
THE OWNER will provide THE RENTER with water, heat, electricity, cable & internet.
All utilities are included in the total rental price.
Internet service (upload and download) is unlimited from a data volume perspective.
Please do not adjust the thermostat to less (cooler) than 73 Degrees Fahrenheit, and please do not adjust the Humidistat to any setting above (more humid) than 'Away'. We do not have a programmable thermostat as we wish our guests to be able to adjust the unit so it is comfortable to them in any weather conditions. This gives our guests the greatest control over utility consumption during their stay. We ask that you please be prudent with Air Conditioning or Heat as the case may be and minimize the unnecessary use of utilities

6. Restrictions
Smoking is not permitted inside the Condo.
Pets are not permitted inside the house or in the pool area unless otherwise agreed with the owner prior. Small non-shedding pets are permitted but an additional Pet cleaning fee of USD$200 will be charged.

7. Damage Protection
The cost of any unreasonable damage caused by THE RENTER will be deducted from the damage deposit initially, and charged to the Damage Protection Policy second.

THE RENTER will be responsible and invoiced separately for any additional damage not covered by either or both of the above.
The damage deposit will be voided and returned to THE RENTER by THE OWNER after the home owner/caretaker has inspected the property. If the damage deposit was sent by Paypal, the funds will be sent back to THE RENTER via Paypal after the same conditions.

In addition to Damage, the Refundable Damage Deposit could be put towards, but not limited to: Excessive Cleaning, pay per view/on demand television purchases, and the like. It is our intention that all Refundable Damage Deposits will be returned, however we must protect ourselves and our Property.

8. Cancellation Policy
Any cancellation by the renter must be in writing via e-mail a minimum of 45 days prior to the commencement of the rental period for a full refund of any funds received. Should you fail to utilize this confirmed reservation or cancel less than 45 days prior to the commencement of the rental period, THE OWNER retains all funds received, other than damage deposit, unless the confirmed unit is re-rented at the same rate for the same time period. If the latter occurs, we retain only a $200.00 administrative fee.

9. General Conditions
House cleaning is included with the rental at the end of your stay, however it is the responsibility of the renters to ensure the property is left thoroughly clean and tidy.

Property must be left in the condition in which it was found. Please do not leave your garbage behind. All garbage must be disposed by you and not left at the house. Deductions from your Damage deposit will result if the above cleaning policy is not adhered to.

The maximum number of guests using the rental premises shall not exceed the total number identified in the rental agreement.
THE RENTER shall, at his expense, and throughout the period of the rental, keep the property in a state of cleanliness and in good condition and repair. THE RENTER acknowledges that at commencement of the rental, the property is in good and substantial repair except for any defect THE RENTER may report to THE OWNER's representative during the first day of the rental. THE RENTER shall leave the property in good repair and cleaned.

The Property Owner and/or the property manager shall be allowed access to the unit at any time during the Rental Period to deal with any issues that may arise, or inspection of proper and lawful use of the property.

LIMITATIONS OF LIABILITY: You will acknowledge and agree in the agreement that you use the home and its community facilities in accordance with the booking agreement and rules. You will use the facilities at your own risk and that you will indemnify and save the Property Owner harmless from any personal injury, sickness or death, loss or damage, however caused, to person or property of this property including his/her family, or guests, during or after the time of occupancy.
Further, you will accept full responsibility for the use of the property and any recreational equipment such as beach seats / toys, bicycles, and agree to pay for any repairs or replacement of said equipment, other than for normal wear and tear.
There is a large Publix supermarket store on Manatee Avenue that is 5 minutes way along with other shops, restaurants, coffee shops all nearby.
The Sarasota/Bradenton airport is a 25-minute drive.
